Q: Who may qualify for a spouse or de facto visa?
For a person to qualify for the partner visa, the applicant and their spouse must:
- be of marriageable age under Australian law, which is at least 18 years of age with certain exceptions;
- the parties have a genuine, continuing and exclusive relationship;
- the parties have legally married either in Australia or their country of origin, unless the parties are in a polygamous relationship where it will be required to show that there is an exclusive relationship between the applicant and spouse, or a visa will not be granted;
- if the parties are in a de facto relationship, the relationship is registered in a Relationships Register in a relevant state or territory, or the parties have been living together in a genuine relationship at least 12 months prior to lodging an application, unless it can be shown that there are other compelling reasons for a visa to be granted.
