Areas of Practice:

  • Land and Environment Court
    • Environmental and planning law.
    • Conducting building and development appeals.
    • Conducting urgent ex parte interlocutory and all forms of injunctive relief in the class 4 jurisdiction of the Land and Environment Court.
    • Conducting hearings involving major residential developments.
    • Advising with respect to Development Control Plans, Local Environmental Plans, Regional Environmental Plans and State Environmental Planning Policies.
    • Advising with respect to prosecutions, particularly in class 5 jurisdiction of the Land and Environment Court but also at a Local Court level.
    • Advising in relation to the preparation of Environmental Impact Statements, Species Impact Statements and various aspects of the flora and fauna legislation.
    • Advising on development extensions, additions, demolitions relating to buildings and developments within conservation areas and for heritage listed items. Advising with respect to the Heritage Act and liaison with the Heritage Commission.
    • Advising extensively on foreshore developments within and visible from the foreshores of Sydney Harbour and major harbour frontages in the Sydney metropolitan area. Advising with respect to foreshore building lines and foreshore scenic protection areas generally.
    • Advising with respect to Seniors Living and Affordable Housing Developments.
  • Mediation
    • Conducting section 34 conferences, mediations, arbitrations and without prejudice conferences in all forums and dispute resolution.
  • Commissions of Inquiry
    • Appearing and representing parties in a large number of Commissions of Inquiry.
  • New South Wales Coastal Policy 1997
    • Advising and participating in Court cases involving the analysis of the New South Wales Coastal Policies, particularly involving coastal erosion.
  • Environmental Audits
    • Gary supervised and conducted the legal environmental audit on behalf of the Maritime Services Board for development in the Port Botany region.

Career Highlights:

  • Since the gazettal of the Environmental Planning and Assessment Act 1979 and the Land and Environment Court Act Gary has conducted in excess of 1,000 Court cases in the Land and Environment Court in all Court jurisdictions and is considered a specialist in this area of the law. He has successfully conducted lengthy and complex cases against Queen's Counsel on numerous occasions.
